What is AFSPA?

The Armed Forces Special Powers Act (AFSPA) is an act passed by the Parliament of India which gives special powers to the Indian armed forces operating in “disturbed areas”. The act applies to seven states of India - Assam, Manipur, Nagaland, Mizoram, Tripura; certain parts of Arunachal Pradesh; parts of Meghalaya bordering Assam and certain parts of Jammu & Kashmir. These areas are declared as “disturbed areas” under Section 3 of the AFSPA which enables the armed forces to undertake any action they deem necessary for restoring peace.

Why was AFSPA created?

The AFSPA came into being after several decades of tension between the Government and separatist groups during which time many civilian lives were lost due to violent clashes between them. It was meant to provide extra legal protection to the armed forces deployed in these conflict zones so that they could carry out their duties without fear of prosecution for any action taken against civilians or insurgents during their duty hours.
